09/18/2007 | Developer of Bain Station Crossing Requests Early Installation of Roadway

On Monday, September 17, the Pleasant Prairie Village Board approved the request of the Developer of Bain Station Crossing to make an amendment to the original Development Agreement executed on July 19, 2007. The amendment will allow the Developer to install curb, gutter and a binder course of pavement along 85th Avenue during the first phase of construction, as opposed to waiting until 50% of the residential units within the Development are constructed. As with similar agreements between developers and the Village, should damage occur to the roadway prior to completion of the development, the Developer has agreed to assume the responsibility for repair or replacement. Damage will sometimes occur due to heavy equipment used during construction.
Additionally, as part of the same amendment the Developer requested to delay improvements at the intersection of 85th Avenue and Bain Station Road until they can further explore improvements planned along Bain Station Road. The 85th Avenue roadway will intersect with Bain Station Road just over one-half mile east of Highway H. It will be the main throughway for the subdivision and future condominium developments and will front its three main areas. The Preliminary Plat for the subdivision was approved on April 2, 2007, and approval of the Final Plat was granted in July. Construction of the improvements at the site began on August 1. Original plans for the property date back years.
The Union Pacific Railroad, on August 23, 2007, formally filed a petition with the State of Wisconsin to close Bain Station Road east of 85th Avenue. The potential closing of Bain Station Road would directly impact access to the subdivision and future condominium developments from Highway 31 on the east. The Village Board adopted a resolution on August 20, 2007 opposing the closing of the road and authorizing the Village Administrator to engage legal counsel to fight the closing.
